Voluntary Interview

Do read the reviews online as I did and am so pleased that I did as they mirror our positive experience. Sunil's website is very informative and has really sound advice re voluntary interview. We were fortunate that Sunil was able to represent my son in a driving charge. For the voluntary interview we were able to meet with Sunil and he worked with my son on a pre-prepared statement. Without this he would not have known what to say, would not have said the right things and would have said the wrong things. We absolutely got the right and the best advice. From the word go I knew we were in safe hands with Sunil's expertise and professionalism which was a great weight off my mind.

Parents often contact me with regard to their adult children as being asked to attend the police station for interview can be a stressful and difficult experience. People often have no idea how to approach such an interview. Others are confident and have clear ideas what to say without understanding that often, their comments in interview are likely to add to the strength of the case against them! In your case, you all met me for advice at an early stage and we were able to prepare an approach for interview. I even drafted a statement that was taken to the interview so that your son could set out his case at the outset. I also advised him generally so that he would be better able to deal with the questions at interview. Eventually, when the proceedings ended you were then able to assess the outcome and it became clear that the favourable result depended heavily on answering the questions appropriately in interview at the start of the process. I was very pleased at the outcome and felt it was deserved. Thank you very much for your review.

After speaking with several solicitors…

After speaking with several solicitors and barristers, we decided to instruct Sunil to support us in my husband's upcoming court appearance. He had pleaded guilty to excessive speeding but we knew the penalties were severe, it would also impact our family greatly and in particular my husband's job would be impacted. Sunil provided a honest, direct and supportive approach in the way he advised us. We only liaised with Sunil either by phone, in person or email. That gave us peace of mind. My husband was given a lenient sentence and we believe that this would not have been possible if we did not have Sunil representing us. Sunil was not cheap but his support and advice was invaluable. We would always suggest that you speak with Sunil about your situation and see how he can support you - we would recommend him.

Voluntary Interview

Voluntary Interview. Pre-Prepared Statement. I was arrested for drink driving and the police asked me to attend a ‘voluntary interview’ on a later date. I had never been in trouble with the police before and had no idea what to say or whether to take up the police offer of a duty solicitor. Luckily I contacted Kent Traffic Law and engaged their barrister for a face to face consultation. I had been caught red-handed and had admitted the offence at the scene and so I was advised that it would be in my interests to fully co-operate with the process. Sunil drafted a statement, based upon my instructions, in which I made full admissions and set out my account. I took this with me to the interview. I attended the interview alone and turned down the police offer of a duty solicitor. The pre-prepared statement was read out during the interview. The police officer clearly appreciated my honesty. When he wrote up the police summary of the case against me he was literally complimentary about the way in which I had co-operated throughout the process.
I also engaged Sunil to represent me in court. He arrived early and ensured everything was ready. When I was sentenced the judge made it clear that owing to the level of my co-operation he was going to give me a disqualification which was markedly reduced in length. Given that I need my driving licence for my work I was really pleased to see this outcome.
It is very difficult to judge what is for the best when you have not been in this situation before. However, it is clear to me now that engaging Sunil from the outset has resulted in the best possible outcome. It was not cheap to engage him but it was very much worth it!

Suspects are often interviewed following upon arrest in which case they are given the option of being advised by a duty solicitor. I have come across many cases in which clients have then booked me for court. In cases such as yours where the police are called to an incident to find the alleged driver at the scene (but not still in the car) I have sometimes found that duty solicitors have advised the suspect to make 'no comment' in interview on the basis that the police may not be able to prove s/he had been behind the wheel. Such advice has even been given in cases in which the only person at the scene who could have been driving was the suspect! Then when I am booked for court and the client tells me they have no intention of doing anything other than pleading 'Guilty' to the offence I ask why they made 'no comment' in interview. The answer is usually they had never been in such a situation before and took the advice offered by the duty solicitor. However, this means that the when the case is in court the suspect's mitigation is less likely to be believed (as it was not set out in interview). The client is also denied the credit for co-operating with the police enquiry to which s/he would otherwise have been entitled. In your case, this situation was avoided as your interview was delayed and you instructed me in the interim. You did not intend to deny the offence and so it made no sense to do anything other than set out your full admission in writing for you to take to the interview with you. You then declined the offer of a duty solicitor and read out the pre-prepared statement you had taken with you. This clearly was appreciated by the case officer who wrote up the summary of your case. When the cps outlined the case against you they relied on the police officer's account and themselves stated in open court how cooperative you had been. As your defence advocate I then addressed the court in mitigation for you and emphasised the extent of your co-operation with the police investigation from start to finish. This clearly impressed the judge who distinguished your case from the one he had heard immediately before based upon the level of your cooperation. He then proceeded to give you a markedly shorter disqualification than would otherwise been the case. If you had made no comment in interview you would clearly have received a longer ban and a more severe sentence. Yours was an example of how taking a pre-prepared statement to the interview and understanding the process in advance stood to your benefit. Thank you for your review.

After my son faced a drink driving charge I contact Sunil at KTL for a chat. Open and honest we spoke for 45 minutes or so and therefore we used his services.

His preparation is thorough and comprehensive, and gave us confidence when attending the court. Helped my son to reduce the penalties received for the charge.

It is a worrying time thus when I receive such enquiries I take the time, as you mention, to clarify matters as best I can during the initial call. After all, people need immediate answers at least to their most urgent queries. Thereafter, as in your case, we met for a face to face consultation, at which you also attended, to prepare for court. Finally, I attended to represent your son. Once again you were in court then too. We obtained the best possible result which was the consequence of dealing with your son's case, from start to finish, personally (rather than sending an agent to represent him in court as most firms of solicitors do). I was charged with drink driving at 18 and found kent traffic law who took on board my personal circumstances and used it to give me the best defence possible to achieve the best outcome my case would allow. As with all clients we had an initial telephone discussion after which you booked a one-to-one meeting. (I personally meet all of my clients to take full instructions). I had obtained the prosecution case papers in advance of the meeting and we considered them together. I advised on how your case should be prepared and personally represented you at court. (I do not use agents to represent my clients in court as solicitors often do). Penalty Points Disqualification!

I was referred to Sunil at Kent Traffic Law via a highly regarded group of supercar owners who have used his services previously.

Penalty points disqualification

I need my license for my job and would be devastated to be banned for 6 months. I contacted Sunil at Kent traffic law as my researches suggested he specialises in this field and, subject to being booked for court, he would personally represent me at my hearing. I spoke to him initially and engaged his services. He arranged a meeting when we went through the facts of my case as well as the law and procedure at court. He was honest with me from the outset and told me I faced an uphill struggle. I very much appreciate the frank approach compared to those lawyers that simply tell you what you want to hear.as the hearing date approached Sunil was in touch to ensure I had everything up to date as per his advice. On the day of court he was actually waiting outside before the doors opened! This enabled us to have another conference inside the building to ensure I fully understood the planned Strategy. In court we were 1st as we signed in 1st.the court heard my case and retired to consider there findings. I new it was touch and go as loss of job is often insufficient to prove exceptional hardship, the court come back and told me I was keeping my license but was very very lucky. I feel sure that if Sunil had not put in 100 percent effort I would have ended up losing my license.

You have accurately described the process from when you first rang me to when we were dealt with in court. I believe that continuity of advice and representation from start to finish helps ensure that the very best case is put forward. However, everyone who would lose his or her job if disqualified from driving for 6 months feels their case is one of 'hardship'. However, loss of job/business/employment is a very, very common consequence of a 6 month ban. The guidelines followed by the court draw attention to the fact that the 'hardship' must be 'exceptional'. This is often interpreted by the courts as meaning that loss of job is insufficient to amount to 'exceptional hardship' in most cases (as it is so common). In your case you were, to quote the court, 'very, very lucky' to leave court without a ban. I take the view that maximum effort in understanding a case, preparing it and presenting it will sometimes get a case over the line that would otherwise have failed. Thank you for your review.

Legal Advice.

Legal Advice.

I found myself in a very difficult position with the penalty points accumulating on my DVLA driving record.
I contacted Kent Traffic Law and found that I was talking to Sunil, a barrister who specialises in dealing
with motoring offences, even though, at that stage, I was simply making an enquiry. I found it invaluable to
be speaking to someone who was knowledgeable and clearly motivated to help me (rather than simply
trying to ensure that I signed up). I had no hesitation in booking a formal consultation and was given

Sunil was great. He is extremely knowledgeable and managed to help me when under unfortunate circumstances I totted up points that should have given me an immediate 12 month ban.
Thankfully. Due to his expertise and guidance I received a minimum ban and small fine which will have minimum disruption to me operating my busy buisness

DRINK DRIVE SENTENCING
After browsing several other companies online, which didn’t give me confidence as it appeared they had inflated ratings and things like 98% success (what does that mean)They just didn’t feel right - too shiny and full of stats. I stumbled across Kent Traffic Law's, it wasn’t all flashy like the others and just felt genuine and the reviews were good. I did my research and kept coming back to Kent Traffic Law’s site. I contacted them by telephone very nervous, the call was answered almost immediately and Sunil could tell I was nervous. He was able to calm me down and explain the process after just a few questions. He thoroughly explained what he would do and differences between his work vs. others. I felt listened to, he understood my issue (which wasn’t great). And gave me options. I agreed to hire him and we had constant contact. Unfortunately the CPS didn’t act fast so we were getting close to the court date without the correct papers. Luckily they came through and after Sunil changed his conference twice for me, we got there. I had some medical records which again I got at them last minute. We had our conference, again nerves got the best of me. Sunil easily put me at ease. We went through the case thoroughly and what I could expect as a sentence (again not great). The conference is very important 1. To meet and 2. To review the case and what to expect at court. Court day arrives (nerves are shredded). I met Sunil in a side room and he explain what would happen. We went through the papers again and I managed to find some more which helped join the dots with the others. I think with Sunil’s experience and evidence in Court I received the best possible outcome. Can’t recommend enough. Thanks Sunil.

The initial enquiry is important and so I personally answer. Just as in your case most people have initial queries which it is helpful to answer straightaway. Then it is easier to make an assessment as to whether we wish to work together. In all of my cases, as with you, I personally meet the client to discuss the facts of the case as well as to establish the nature of your mitigation (which partly stems from the facts of the case and partly from your personal background). We go through the prosecution case papers together at this meeting (if we meet before we have obtained them you derive less benefit from the meeting which is why we put it back twice to ensure we had read them before we met). I also give advice at the meeting as to any steps you should take in advance of your court date. This varies widely from client to client but, in your case, you followed up to obtain the documents we needed. On the day in court we both arrived early (I personally attend; I don't delegate to a junior barrister or a local solicitor in any circumstances). I answered your last minute questions and we discussed matters again and ensured we were both completely ready. Then, fortunately, we were called on first. (I always prefer this if possible in case any other Defendant is sentenced harshly in a case where the alcohol level is similar to that of my client. Once a harsh sentence has been meted out in a case with a similar alcohol level it can mean it is harder for my client to obtain the result we have targeted - as the courts tend to keep to a standard once it has been set). In the end we obtained the result we sought. I am pleased you were happy with the outcome. Thank you for posting your review.

When you drive for a living it is very easy to rack up penalty points over a 3 year period. The hazard then looms of a penalty points disqualification and a job ending 6 month ban. Sometimes this can be averted by persuading the court, on any one occasion, to endorse fewer penalty points than they otherwise would have done. Speeding son a parents prospective

We needed the help from Sunil of Kent traffic law as our 17 year old son was caught speeding weeks after obtaining his licence, caught in a notorious place, unlucky in our view. He needed his licence for work and to get to and from the gym, he’s an elite athlete.
Sunil took out case, we had a through telephone conversation followed by a meeting to discuss all the details.
On court day, we knew what to expect as he had explained it all so well. Representing my son, we couldn’t have asked for better, the advise he gave us beforehand was invaluable and his words in court, saved my sons licence.

New Drivers are at greater risk than the rest of us of loss of licence (as licences are automatically revoked in cases in which they incur 6 points for offences committed within 2 years of passing their tests). When livelihoods and careers are at stake it is understandable that they want to maximise their chances of avoiding licence revocation. I was happy to meet you and your son to prepare his case. If you have been affected by something like the above, without any hesitation I’d go to Sunil asking him to represent you.

Sunil recently represented me in court, and I couldn't be more impressed with the level of service and expertise provided.

I had plead guilty to a SJPN and subsequently received a summons to attend a court hearing regarding disqualification. I found Kent Traffic Law through an internet search and reached out to Sunil. Penalty Points Disqualification

When our son received 7 speeding summonses over a 3-day period our first reaction was to panic. We knew that 12 points (4 summonses) meant a disqualification, so with 21-23 points he would certainly get a long disqualification which would result in having to abandon his university course.
We decided we needed some legal support. We checked on the Internet and were surprised to see that one company - Kent Traffic Law – was run by a barrister. We had assumed that we would have to go to a firm of solicitors who would go through the case and then assign a barrister to represent our son in court.
We sent a synopsis of the case and a summary of what we thought to be mitigating factors to Kent Traffic Law asking if we could discuss the case further on the telephone.
We got a speedy response to our request and telephoned Kent Traffic Law at the appointed time. We immediately got talking to Sunil, the barrister who runs Kent Traffic Law, not an assistant or an intermediary who would relate the information to Sunil – we were talking to the person who would represent our son in court.
Sunil had thoroughly read and digested the document that we had sent to him. We spoke on the telephone for almost 1 hour and he explained in detail how the legal system worked, how our son should plead, how long, roughly, the process would take and gave us an outline of the arguments that he would put forward in court.
At our son’s hearing in front of the magistrates Sunil was persuasive, succinct and compelling. The court accepted all the points he put forward and our son received a driving ban of less than 2 months which was infinitely better than anything we could have hoped for in our wildest dreams.
Sunil is superb, knowledgeable, understanding and, in our case, substantially overachieved.

Your son's was an exceptionally difficult case in that avoiding an extended penalty points disqualification for someone who would incur in excess of 20 points was a very tall order. Yet, given that your son required his driving licence to follow his chosen vocation you refused to give up and instructed me to do whatever I could. On examination of his case it was apparent that a ban in excess of 6 months would have been a disaster for him but also that, if we succeeded in establishing 'exceptional hardship' and avoided a ban altogether this would be equally disastrous (as the points would have remained on his licence and effectively disqualified him from his chosen vocation). We needed to aim for the bullseye ie to prove 'exceptional hardship' but persuade the court to ban for a short time so that he would avoid an extended ban and avoid having the points remain on his licence (as even a short penalty points disqualification 'wipes the licence clean of points'). We analysed his case in detail, obtained the relevant documentary evidence to prove his case and decided to go for broke in court. Very fortunately the court accepted all of our submissions and sentenced your son in a way that gave him the best possible chance of pursuing his career. There was, of course, a story to his case that we cannot set out here (for lack of space). It just goes to show that parents who refuse to give up sometimes find a way! I was arrested while sitting in my car with a breath test high above the limit. A ‘duty’ solicitor provided by the police looked into records and briefly asked me about my case. He advised I say ‘No Comment’ to all questions during the police interview (later I realised it has completely spoiled my case) and said that usual expectation is to get a 12-months ban but he will try to reduce it to 9... At first, I was thinking about going with the “duty” solicitor firm but, after reading the poor reviews, decided to look for a better representation.
I was very lucky to find Sunil and even luckier that he had time to represent me on the date of my hearing: he was very kind to take on my case despite having another hearing in the afternoon on the same day.
I understood Sunil is an incredible professional from first minutes of our initial phone call. He spent about an hour asking necessary questions sufficient for the detailed and clear story, explaining my options and what he can offer before I decided to go with his service.
It is very rare, that you can deal with a barrister directly and he is working on your case 100% of the time. Usually, you deal with a chain of people staring with someone very junior and then a solicitor (not barrister) probably spends 15min with you before the hearing. With Sunil it was very different. Once he took my case on, he interviewed me for 2 hours to find out all of the details, thought the defence strategy and recommended the best possible action.
Sunil knew both, the judge and the prosecutor since the beginning of their career and Sunil’s level of expertise and reputation were obvious for everyone in the room. I was surprised how smoothly the hearing went. Sunil knew the case precisely, was talking directly to the judge never looking into papers, ready to maneuver depending on prosecutions questions.
After pleading guilty and Sunil’s representation I was given the lowest possible penalty of the available range – 10 points and a (very reasonable) fine. I am simply delighted with the result. Given the case spoiled by the initial ‘duty’ solicitor, Sunil helped me get the best possible outcome – saved me from a ban. He is a highly experienced professional you can rely on (has been on both sides as a barrister and a prosecutor). And what I especially appreciated about working with him – he was strictly following the code of conduct for legal profession and only telling the truth about my case.
It was actually pleasant to work with him and very reassuring to have him by my side through this rather unpleasant process. I felt that I was very well taken care of.
I can only hope that other people in similar situations are able to find Sunil to represent them.

Each case turns on its own facts and it is only by going into detail with a client that one can begin to understand how his or her case should be put to a court. In your case you were indeed caught behind the wheel of a stationary vehicle with a reading well above the drink drive limit. However, there turned out to be an unusual and completely genuine explanation for your conduct. Of course, you were advised to make 'no comment' in the police interview and followed that advice but no one had explained to you that, in your particular circumstances, you stood to gain by explaining your full situation to the police. Had you done so the point could have been made in court that your account in court was consistent with that given in interview; instead it had to be explained that you had simply followed the advice that you had been given at the time to make no comment. Fortunately, the court fully accepted the mitigation and understood how you had found yourself in such an unfortunate situation. Consequently, the judge felt able to give you the most lenient penalty possible which meant, of course, that you were not disqualified from driving. Thank you for your review.

Usually the minimum ban in such a case is 6 months unless the Defendant can establish 'exceptional hardship'. We were unable to make such a submission as there was no such hardship in your case. However, the court decided to disapply the sentencing guidelines in your case in order to avoid the usual 6 month ban! This was a most unusual outcome (to the extent that I cannot recall a court agreeing to disapply the sentencing guidelines in any other case I have done). However, I am pleased for you that they did so. Thank you for your review.

Drug driving - in charge

This is a serious charge as it can result in severe consequences such as imprisonment and disqualification from driving depending on the facts of each case. The task of the defence lawyer is to work out the best approach for the Defendant and then to execute that strategy in court.
