In this case advice had already been given by solicitors that a disqualification could not be avoided. However, having taken full instructions it became clear that there was a 'story to tell', by way of mitigation, that, if believed, could, possibly, mean a ban could be avoided. Fortunately, the court accepted the defence version of events. Depsite 'Guilty' pleas to a series of offences the court elected not to disqualify at all. Thank you for your review.

Drink Driving Guilty Plea

Drink Driving Guilty Plea

I phoned Sunil for information on drink driving for my son, who had been driving his car whilst over the limit, went around a corner in a narrow road, hit a tree and flipped the car over. Luckily, he was not hurt and did not have any passengers. The car was blocking the road.
When my son received the court papers, the offence information was wrong, wrong date, wrong car, wrong road, but as Sunil said the court can change this on the day with no problem, and they did. All the other information submitted to the court by the police was correct.
Sunil told me exactly what will happen, any drink drive charge carries a mandatory ban of your license. There is no way you can get off this.
Sunil represented my son in court and what he said would happen, did happen. My son pleaded guilty, he got a 12-month ban, was allowed the to the drink drive awareness course, which will take 25% off his ban, making his ban 9 months. He also had a small fine of £200. We feel this was a good outcome as he will be back on the road in 9 months.
I did previously phone another company who said they could represent my son in court, but they advised him to plead not guilty and they would get him off on a technicality as the offence was wrong on the court letter. We now know this can be changed on the day at the court. This company said they could challenge the blood readings as they may also be wrong. We now know that the blood was signed off by doctors, police and my son at the time it was taken. There is no way this could be wrong.
If we have of gone with this other company, it would have cost us more money, more court appearances, which would have wasted court time and therefore would have meant a longer ban and not been able to do the driving awareness course to reduce the ban by 25% and maybe even a bigger fine.
Sunil got my son the best outcome of a bad situation.

Even the strongest case can be contested but sometimes this will achieve little more than prolonging proceedings and increasing legal costs. Insisting upon a trial also means that the Defendant will lose 'credit for the guilty plea' ie his sentence will be more severe. Therefore, it is always worth carefully considering whether any apparent errors in the charge sheet can easily be overcome by the cps simply by seeking to amend the charge at court. This is what happened in this case as the underlying evidence all showed that the charge sheet errors were simply that ie errors which in no way actually misled the defence as to the merits of the case. Unless the defence can show it would have been disadvantaged by the amendments the court will usually allow them. This is what happened in your son's case. Fortunately, the court then gave due weight to his full co-operation as the minimum level ban of one year, which is mandatory upon conviction, was imposed. This is unusual in a case where the car has been flipped over and the road was blocked which underlines that your son, in fully co-operating from start to finish, had adopted the best approach given his circumstances. The court also allowed him to take the Drink Drive Rehabilitation course which means he will be back on the road after only 9 months! I am pleased he received the result you sought. I am always frank with clients explaining my thoughts from the outset as to the range of potential outcomes. Once we have met, usually face to face, and I have taken detailed instructions I am then in a position to give formal legal advice. I am a Taxi driver

I am a Taxi driver. Someone reports when I overtook them in M25 with their dash cam. The police sent me a letter about dangerous/Carles and aggressive driving codes. I was so worried about losing my taxi / driver license and also worried about the fine. I was searching on Google about dangerous/careless / ban and Suddenly found "Kent traffic law" with 5* reviews. I was reading most of the reviews and called them straight away. Mr Sunil received my call, I explained my situation and we both agreed to arrange a meeting. Mr Sunil wrote the draft and I sent it to the police officer. After a few days the police called me for a voluntary interview. I was so worried when Mr Sunil arranged for me a solicitor named Mr Graffiti who came to the police station and checked the VDO and we were both prepared to attend the interview. The interview was so positive because Mr Sunil and Mr Graffiti put full effort and the outcome is three points in my license and dismissed the case. I strongly believe without Sunil I wouldn't get this result.

Excellent lawyer/barrister

Sunil Rupinsahara had excellent reviews on his page and he was the first of many road traffic solicitors/lawyers to pop up. I was charged with driving without due care and attention and as this was a serious matter i realised i needed someone that knows what they are doing and what they are actually talking about! Sunil managed to get me the most lenient sentencing possible which i was very glad about. He was well prepared and advised me of how everything works as i have never been to court before. Highly recommended i would say to definitely approach this man for all your motoring troubles/concerns.

The right man for the job!

After not receiving a summons in the post and finding out I was in court via a text from the police explaining the rules for my court appearance the following week, you could imagine the panic. I found Sunil through some frantic googling and just happened to find the right man for the job!

Sunil immediately put me at ease on our phone conversation and even though we had a very short dead line he was happy to take the case. We arranged to meet and discuss the severity of my specific case in which Sunil didn’t sugar coat anything or make any promises, he only dealt in the facts. When Sunil arrived at court he explained his final plan and immediately got to action, he even managed to get one charge dropped before we had even got in to courtroom! Once in the court room he delivered an excellent speech and pleaded my case which the utmost professionalism and got me a very lenient sentence considering the severity of my case.

I am very happy with the work Sunil provided and I would recommend him to anybody and everybody!

This was a serious case which required careful preparation. Once engaged by you I obtained the case papers from the cps which we considered in detail at our initial meeting. We formulated a plan as to how we would proceed. We both arrived early at court on the day to ensure we were ready early. Then I popped into court to await the arrival of the prosecutor. Having prosecuted for many years I knew how best to negotiate with him. He duly agreed to drop one of the cases against you. This simplified matters for us and it became a case of seeking to persuade the court of the validity of your mitigation on the remaining charge. As you know the District Judge (Magistrate) accepted this in full before imposing a satisfactory sentence (from our perspective). Careful preparation and persuasive presentation did the trick! Driving without due care and attention

Driving without due care and attention:

My name is Marko.
The first time I spoke with Sunil, he explained to me thoroughly the situation that I am in, how things will work and what I will be facing at in court - before he took any fees.

I was involved in a multicrash accident in which I plead guilty for careless driving. All of the statements, including a written police officers one, led to me being guilty. However, I did not agree that I was fully guilty as I was affected by other factors.

Sunil looked over the case in detail and thoroughly used all of the evidence he had to prove and present to the court that my guilt was caused by other external factors. I did plead guilty for the part that I caused but Sunil helped the court understand the contributing factors that led to me causing the crash.

The outcome of the court case meant that: I had a minimal penalty on £26 to pay, a one year probation (which is the minimum I could receive) and a clean driving license with no points. As a HGV lorry driver, I could not afford to be exempt from driving or have 6 points on my driving license - which I would have had, without the support of Sunil.

Sunil was very supportive and efficient from start to finish and I could not recommend him enough.

Your case involved a multiple pile up on a slip road to the M25 in the rush hour. You stopped your vehicle abruptly and one of the vehicles behind could not stop in time. The police attending the scene held you alone responsible. It was true that you were at fault but not nearly as much as some of the other drivers (none of whom was prosecuted). We put this right at court by explaining, with the use of dash cam footage, that other drivers were much more at fault than you. The court agreed with us and in the end found 'special reasons' in your favour (which was the reason no points were endorsed on your licence and why they gave you a conditional discharge). This was especially important as, as an HGV driver, you had told me that more than 6 points would mean you would lose your job. I am pleased the court ruled in your favour and you are able to continue in your job as an HGV driver. Thank you for your review.

Response to Notice of Intended Prosecution.

I received an NIP from the MET Police in relation to a incident with a cyclist. I then contacted Sunil at Kent Traffic Law who was very quick to repsond and offer an appointment to establish all the facts in my response to the police. Sunil was very professional throughout and offered excellent advice and is extremely knowledgeable in his field. The Police responded with no further action to be taken and had I not gone to Sunil, I do not think this would have been the outcome because incidents involving cyclists can almost always have a different outcome. Fortunately, in my case, no further action was taken and this was a huge relief on myself and my family.

How you respond to an NIP can be absolutely critical in helping to shape the police response to a complaint. The worst case is that they accept the allegations in full. The best is that they drop the case altogether. I can use my experience of the law and of police practice, listen to your account, and then, advise you how best to respond. This can mean the difference between having to go to a trial in court (with all the expense, stress and risks of conviction) and between having the case dropped at the outset. However, you are a busy professional who is called upon regularly by patients to attend to them, sometimes at short notice. Drink driving

I am Dean I was caught drink driving also falling to provide a sample , I was sentenced to appear at court looking at possibly three months to one year imprisonment with this I went on google were I found Kent Traffic Law which had excellent reviews. I spoke with Sunil and explained my situation. Through his extensive knowledge in this field I was given I lighter sentence with no imprisonment so as you can imagine I was elated with the outcome . Sunil is a true professional in his field.

When you first contacted me, told me you intended to admit the offences, and described your case on the phone I told you straightaway that you might well be in the prison bracket for sentencing. Once I obtained your case papers from the cps this was confirmed. However, it is important to note that, although your sentencing bracket could easily be in the prison category, this doesn't necessarily mean that the court will sentence you to an immediate custodial sentence. There are various options open to the court and my task, in your case, was to try to maximise your chance of avoiding a prison sentence. No comment interview

No comment interview

After a crash while drunk and on drugs. I contacted National motoring lawyers. Whose advice was to give a no comment interview and a not guilty plea. After doing the interview I had a light bulb moment. And searched around for further advice. When I contacted Kent traffic law and spoke directly with Sunil. It was obvious I had made a massive mistake. I contacted the officer to arrange another interview Luckily he agreed.
I met Sunil and went through everything from start to finish. He wrote me a pre prepared statement to take to the interview.

After being charged with four offenses. I contacted Sunil again and we then met up with plenty of time before the court date. To again go over the case and defense. He couldn't promise the outcome as they were serious offenses. But made me feel very confident he would do his best for me.

We met at the court where Sunil gave me a run down of what to expect and possible outcomes. Before I was even called into the courtroom he had managed to get one of the charges dropped. In the courtroom he was brilliant at getting my side across. I could not be happier with the result.

You're in great hands with Sunil. He genuinely has his clients best interests at heart.

If you are to attend a voluntary police interview it is really important that you understand the process and that you are able to make an informed initial assessment of the likely strength of the case against you. Although even the strongest case can be contested it may only result in a conviction and much higher legal costs in the end (as well as a harsher sentence). Therefore, in some cases when there is a strong likelihood of conviction a Defendant may be well advised to actually make admissions in interview rather than simply making 'no comment'. In your case, after attending your second interview and making full admissions the court was convinced that all of your mitigation was genuine. This assisted me in persuading the prosecutor to drop one of the charges. In the end the court wanted to help you rather than punish you. This was the consequence, in part, of being honest in your second interview. Each case must be assessed on its own facts but I was really pleased this approach worked for you. Speeding

Speeding - Court Letter.

I was recently caught speeding and received a Single Justice Procedure Notice. I was doing far in excess of the speed limit but was hoping to avoid being called to court to face a potential disqualification. One of my colleagues from work put me in touch with Mr Sunil Rupasinha. I was lucky he was able to meet with me. He asked me to tell him everything slowly and in detail. Then he drafted a concise letter setting out my case for avoiding a ban (based partly on the facts of the case and partly on my circumstances). I was really relieved to find that I did avoid a ban without even being required to attend court! Thank you very much, Mr Sunil.

If you If you are exceeding the speed limit by a big enough margin you will almost certainly be required to attend court for consideration of a disqualification. However, there is a grey area in which one might expect to be required to attend but it might just be possible to persuade a magistrate to sentence you with points and a fine without the need to attend. Your case was within the 'grey zone'. Luckily you did not need to attend and you avoided the risk of a ban ie the outcome we sought. Thank you for your review.

HGV Driver

Today I thought I was going to lose my career as a HGV driver. What this man done for me in court far outweighs any superlatives I could possibly conjure up . The expense of having a barrister take my case pails into insignificance when weighed against losing what’s left of my career. My one biggest regret is I didn’t go to him first before pleading Guilty ( by Post) and the relief to get a fine and points when I was facing disqualification is unbelievable.

You then engaged me. We prepared carefully for court and I presented your mitigation today. Fortunately, the court accepted the mitigation in full and simply endorsed 6 penalty points and a fine (which you had advised me would enable you to keep your job). I note you state you wish you had consulted me before you had tendered your pleas (in which case we would have considered pleading 'Not Guilty'.) However, we obtained the best possible result in the circumstances (which, when you need your licence for your job, is of the utmost importance). Thank you for your review.

Drink Driving

Drink Driving. This was my second offence within 3 years. I was caught bang to rights by the police and intended to plead ‘Guilty’ but had concerns about the severity of the sentence and the effect it would have on my working career. The last thing I wanted was a longer ban than necessary and a community penalty with conditions such as a curfew and tag (which in my case was a great possibility). A friend of mine gave me Sunil’s details as he had been really pleased with the outcome of his case. I contacted Sunil, finding him to be friendly yet professional. Also meeting with him prior to my day in court to ensure both of us were prepared. My day in court Sunil got me the best possible result (the minimum ban and a fine). I paid extra for this specialist but have no doubt he was worth every penny.

The courts have a wide array of sentencing powers for offences such as drink driving from an immediate prison sentence to community penalties to fines. As you point out community penalties can be very harsh indeed sometimes comprising hundreds of hours of work and being combined with tagged curfews, for example (just one option). A ban is always ordered. However, the length of the ban and the severity of the sentencing are matters in the discretion of the court. Therefore, even on a 'Guilty' plea there is potentially a marked difference between the harshest and most lenient of potential sentences for any given offence. Therefore, the aim is always to get the most lenient sentence possible. I am glad this was achieved in your case. Thank you for your review.

Drink Driving. Guilty Plea

I had previously spoken to drink driving solicitors who had advised me to plead ‘Not Guilty’ as I was outside of the car when the police caught me. I was desperate to avoid loss of licence. Sunil explained to me that as there was no one else around at the time of the incident the court would very probably conclude I was the driver and so pleading ‘Not Guilty’ was not in my interest. I decided to plead ‘Guilty’. When I saw the evidence I realised I would have stood no real chance of winning my case had I persisted with a ‘Not Guilty’ plea. Sunil met me to prepare my mitigation and presented my case in court. The judge accepted every word he said and told me he was sentencing me very leniently (which he did). I was really pleased with the result and realise now that Sunil advised me in my interest not his. It was really worth the extra cost of using a specialist motoring offence barrister instead of a solicitor. Thank you, Sunil.

Often motorists are desperate to avoid a conviction and disqualification not least because their livelihoods often depend on their driving licences. Thus when they are encouraged to believe that it may be possible to find a loophole in the police paperwork they readily accept this. Often, if caught outside of the car they may be encouraged to believe the police will have difficulty proving they were driving. As you realised when you saw the case papers the case against you was, on the face of it, very strong indeed. Pleading 'Not Guilty' would have significantly increased your legal fees and ensured that you missed out on the 'credit' a court gives for a 'Guilty' plea. In this case, as you saw, such credit can be really important when it comes to trying to persuade the sentencing court to show leniency. I am really pleased this all worked out so well for you. I was summoned to court for a motoring…

I was summoned to court for a motoring offence.

I was initially hesitant to pay so much but after contacting many other firms I found Sunil was straightforward as he gave me honest advice before committing to any casework. He came across as genuine and most importantly gave logical reasoning.

Sunil prides himself on transparency, integrity and takes an honest approach.
I am sincerely impressed with his intellect.
