Fraudulent inducement – undisclosed no-refund clause

On May 13, 2025, I paid $7,500 USD to Apex Navigator, LLC. The contract was drafted in English and verbally translated to me by a company representative, but critical terms were deliberately omitted, specifically the “no refund under any circumstances” policy and the waiver of chargebacks.
This omission prevented me from making an informed decision and constitutes fraudulent inducement. I have documented evidence, including a video of the contract signing, messages, and communications that clearly support my case.
I have formally requested rescission of the contract and a full refund, but to date I have received no resolution. I am proceeding with complaints before the BBB, FTC, and state authorities, as well as filing a claim in California Small Claims Court.

You enrolled in the Passive Apex Program on May 13, 2025, with a payment of $7,500 USD.

You received all contracted services and more, including:
✅ Full Amazon store setup and onboarding (in both Spanish and English)
✅ Personalized 1-on-1 coaching sessions
✅ Complete setup of SellerAmp, Keepa, and related tools
✅ Assistance opening supplier accounts with bilingual support
✅ Ongoing WhatsApp support confirming your participation, progress, and satisfaction

Although you chose not to hire a virtual assistant to avoid extra costs, our internal team performed those duties for you at no additional charge.


You signed an agreement on May 14, 2025, which clearly stated “no refunds for any reason” and “no chargebacks may be pursued.”
Despite this, you filed a dispute with American Express, which, after reviewing all evidence, ruled in our favor and denied your claim.

You also reside in the United States and speak English fluently, which means you fully understood the program’s terms and conditions before enrollment. Attempting to recover funds after a denied chargeback is not a lawful or fair action.

At Apex Navigator LLC, we acted in full good faith, delivered all promised services (and additional support beyond contract terms), and maintained open communication throughout your program.

This matter is fully resolved, supported by clear documentation and the decision from American Express in our favor.
