Parcel lost. No refund. Even though it’s against law!
No refund even though the product got lost in the post.
They told me I provided the wrong address, which I even have proof I did not. So I send proof.
Then they made me go to a different address (where my parcel should be) and it was not.
Then they made me contact the Italian post, which I did and received no info.
I informed them that by EU law they have to refund me but they didn’t.
Demy in client service answers rudely and doesn’t care about his clients.
My lawyer has been informed.

Thank you very much for your response. I believe you are not very well informed about your responsibilities. Pls let me help you:
“ The seller will always be responsible for the package containing their product until it gets to the purchaser. This essentially means that as an e-commerce seller, you are responsible for the package until it is officially delivered– even though the package is no longer in your possession...
… the consumer rights kick in if an item goes missing en route. The business is responsible from the moment an item gets sent on its way until it reaches the client.”
Furthermore I helped you finding the parcel. Demy sent me 15 minutes away to check a different house number. Where I had to ask random people if they had found my parcel. Also I contacted PostIT which - if you knew about your responsibilities - is not anything I have to do. Up to today I haven’t heard a single “Sorry” “we want to help” “we make sure you get your money back” - all I hear is “we are looking for the parcel”. Let me put it very easy for you. I ordered and didn’t receive - you are in the responsibility to refund me!

Wird bei einem fernabsatzrechtlichen Verbrauchsgüterkauf aufgrund der Abwesenheit des Empfängers an einen Nachbarn zugestellt und geht die Sendung im Folgenden vor der Übergabe an den Adressaten verloren, liegt ein zufälliger Untergang vor, für den der Händler wegen § 475 Abs. 2 BGB grundsätzlich gefahrtragungspflichtig ist.
Als Frachtführer haben Sie nach § 407 Abs. 1 HGB die Sendung nicht wirksam zugestellt.
Gemäß § 280 BGB muss Schadenersatz für das nicht ordnungsgemäß zugestellte Paket geltend gemacht werden.
