Incorrect legal advice
I originally paid boligadvokat24 to review a proposed sales agreement (købesaftaler) for the sale of my house - the sale was unusual in that I was only selling my share of the house (50%). The lawyer from Boligadvokat24 reviewed the document and advised me strongly against signing because the document made no mention of an offer of paying 50% of ejerskifteforsikring (ownership change insurance) which would mean that I would be liable for structural issues to the house for the next 10 years.
I thanked the lawyer for their advice, and agreed to pay boligadvokat24 to create a more “professional” sales agreement.
I provided the information that was requested and was contacted by a second lawyer from Boligadvokat24 who provided a draft "with still a couple of things to fix up"... There were over 20 errors in the contract (I had to make a 4 page pdf explaining all of the errors and the corrections needed) including:
- The addresses were messed up so the contract stated that the buyer was purchasing their own property, not mine!
- The long form version of the purchase price was incorrect
The next day I wrote back with an explanation of all the errors.. but I never heard from the second lawyer again. The first lawyer contacted me and said that the second lawyer had left the company suddenly. The first lawyer was apologetic and said he would get the contract fixed up and make things right.
After some delays and several late night phone calls to say he was working on it, the first lawyer wrote back with a 2nd version. He hadn’t had time to get to all of my comments which was annoying because I had to cross-corelate and find which changes had been made and which were not. The contract was much better, I only had a few comments. Two days later the lawyer provided a 3rd version but by this point the purchaser has lost all faith in the ability of boligadvokat24 to make a correct legal contract and I could not defend them. The purchaser found their own lawyer to make a new contract. The lawyer from Boligadvokat24 agreed that he will support me in reviewing the new contract after it gets made - which was good of him.
After the new contract is made the lawyer from Boligadvokat24 completed a review and advised me: don’t sign it as it was still missing the offer of paying 50% ejerskifteforsikring which will give me liability for the next 10 years!
There are a couple of arguments with the purchaser's lawyer who said that in this case that it is not possible to get ejerskifteforsikring. the lawyer from Boligadvokat24 finally talked to the other lawyer and then said... ejerskifteforsikring is maybe NOT possible to get in this case as one of the owners of the house is staying in the house and has knowledge of the house and any potential defects. I should therefore “ring around” some insurance companies and see if any will provide ejerskifteforsikring in this case… Is this the sort of professional advice I am paying for?!
I rung up a couple of insurance companies and they all confirmed that they will not provide ejerskifteforsikring in this situation. Now I am mad. The whole reason that I got Boligadvokat24 involved in the first place was because they advised me that I had to make an offer of paying 50% for ejerskifteforsikring and it is not even possible to get that. I am also worried because I don’t know if I have potential liability now?
In the end I just closed my eyes and signed the purchaser’s contract blindly as I was out of time.
Positive Points: All three of the legal secretaries that I dealt with from boligadvokat24 were very professional and organised. But I am paying for a professional lawyer, not the secretaries.
